MASSACHUSETTS' NEW RULES REQUIRING LICENSURE AND CERTIFICATE OF NEED (CON) FOR ALL ASC's


Massachusetts Revisions 105 CMR 140.000
June 2009


MA revisions (105 CMR) include:

  • Required licensure of ALL Medicare certified ambulatory surgery centers
  • Serious reportable events (SRE's) reporting
  • Healthcare Acquired Infections (HAI's) reporting
  • Medical Records Retention

Note:
The statute may levy a penalty of up to $1,000 per day and/or revocation or suspension of an ASC's license for failing to comply with the reporting requirements of Section 51H.

NEW STATE LAWS REQUIRING ACCREDITATION

Many states (listed below) have laws requiring licensure and/ or accreditation.
