MASSACHUSETTS' NEW RULES REQUIRING LICENSURE AND CERTIFICATE OF NEED (CON) FOR ALL ASC's

Massachusetts Revisions 105 CMR 140.000
Effective Date: June 2009
Compliance Date: December 2009


MA revisions (105 CMR) include:

  • Required licensure of ALL Medicare certified ambulatory surgery centers
  • Serious reportable events (SRE's) reporting
  • Healthcare Acquired Infections (HAI's) reporting
  • Medical Records Retention

Please know:
The statute provides a penalty of up to $1,000 per day and/or revocation or suspension of an ASC's license for failing to comply with the reporting requirements of Section 51H.
